Terms of Service

1. Acceptable Use

You may use HeyStackIQ only for lawful B2B go-to-market purposes. You must not use the Service to send unsolicited bulk communications, harass individuals, violate any applicable law or regulation, circumvent sanctions, or engage in any activity prohibited by this Acceptable Use Policy.

You are solely responsible for ensuring that your outreach activity — including emails, sequences, and automated workflows — complies with all applicable laws, including but not limited to CAN-SPAM, CASL, GDPR, and local data protection regulations. HeyStackIQ provides tools; compliance with those laws is your responsibility.

2. Third-Party Data Connectors

HeyStackIQ integrates with third-party data providers (including but not limited to Apollo.io, Hunter.io, Explorium, and HubSpot) via API keys you supply ("Bring Your Own Key" or BYOK). By connecting a third-party provider, you confirm that:

• You have a valid, active subscription to that provider.
• You will use data retrieved through that provider strictly in accordance with that provider's own Terms of Service, data licensing terms, and acceptable use policies.
• You will not use HeyStackIQ to extract, store, or redistribute data in a manner that violates the provider's terms — for example, using Apollo.io data to build a competing dataset is expressly prohibited by Apollo's ToS regardless of how the data is accessed.

HeyStackIQ does not guarantee the legality, accuracy, deliverability, or compliance of data sourced from third-party providers. You bear all responsibility for how you access and use third-party data through our platform.

3. AI-Generated Content & Data Accuracy

HeyStackIQ uses artificial intelligence — including large language models and public web search — to generate firmographic enrichment data, contact identification, account scoring, and go-to-market recommendations.

AI-generated enrichment, scoring, and recommendations may be incomplete, inaccurate, or outdated, and must be reviewed by a human before use in business decisions or outreach.

HeyStackIQ sources enrichment data only from publicly available information. We do not access authenticated user sessions, scrape LinkedIn behind login, or store proprietary licensed database content beyond what your own connector keys permit.

4. Contact Data & Personal Information

Contact records discovered or enriched by HeyStackIQ may contain personal data (names, titles, email addresses). You are the data controller for all contact data stored in your workspace. You must:

• Have a lawful basis for processing contact data under applicable law.
• Honour unsubscribe requests and deletion requests promptly.
• Not use contact data for purposes other than legitimate B2B outreach to relevant business contacts.

Contact records are stored with a default retention period of 180 days from creation. You may delete individual contacts or all workspace data at any time via your account settings. Deleted contact emails are automatically added to your suppression list to prevent re-creation.

5. Email Outreach & Suppression

When using HeyStackIQ to send emails, you agree to:

• Include a clear and functional unsubscribe mechanism in every outbound email.
• Process unsubscribe requests within 10 business days.
• Never send to contacts who have unsubscribed, bounced, or filed spam complaints.
• Not send misleading subject lines or sender information.

HeyStackIQ maintains a per-workspace suppression list. Unsubscribed, bounced, and manually suppressed addresses are automatically excluded from future sends.

6. Email Resolution (Hunter.io & Similar)

HeyStackIQ supports just-in-time email resolution via third-party providers such as Hunter.io using your own API key. Email resolution is triggered only at the point of outreach for individual contacts — never in bulk. Resolved emails are cached for 24 hours to minimise API usage. You are responsible for ensuring your use of email finder services complies with those providers' terms and applicable privacy law.

7. Account Responsibilities

You are responsible for maintaining the confidentiality of your login credentials and API keys, and for all activity that occurs under your account. You must notify us immediately at security@heystackiq.com if you suspect unauthorised access.

8. Intellectual Property

All content, features, and functionality of the HeyStackIQ platform are owned by HeyStackIQ and are protected by applicable intellectual property laws. Your data remains yours — we do not claim ownership of contact records, ICP definitions, or outreach content you create.

9. Limitation of Liability

To the maximum extent permitted by law, HeyStackIQ shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to: inaccurate AI-generated data, third-party provider downtime or policy changes, outreach deliverability issues, or regulatory penalties arising from your outreach activity.

Our total aggregate liability to you for any claim shall not exceed the amounts you paid to HeyStackIQ in the three months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you by email or in-app notice at least 14 days before material changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
